Terms and Conditions for Purchasing Goods

1. General Provisions

1.1. These terms and conditions for the purchase and sale of goods (hereinafter - the "Terms") are a legally binding document for the Parties, which establishes the rights, obligations, and responsibilities of the Buyer and the Seller when the Buyer purchases goods from the LaBody e-shop.

1.2. The Seller reserves the right to change, amend, or supplement the Terms at any time. When the Buyer shops in the e-shop, the Terms valid at the time of placing the order apply.

1.3. The right to purchase in the e-shop is granted to: natural persons with legal capacity; minors between 14 and 18 years of age, only with the consent of their parents or guardians; legal entities; authorized representatives of all the above-mentioned persons.

1.4. The Seller guarantees that the Buyer has the right to purchase goods from the e-shop.

1.5. The e-shop contract is considered concluded when the Buyer places an order and the Seller sends a confirmation by email.

2. Personal Data Protection

2.1. The Buyer can order goods in the e-shop by registering or without registering.

2.2. The Buyer must provide: name, surname, delivery address, postal code, phone number, and email address.

2.3. By confirming these terms, the Buyer agrees that their personal data will be processed for the purpose of selling goods and services in the LaBody e-shop.

2.4. The Buyer agrees that informational messages necessary for the fulfillment of the order will be sent to the email and phone number provided.

2.5. The Buyer undertakes to protect and not disclose login data to anyone.

2.6. The Buyer's personal data will be processed in accordance with the Law on Legal Protection of Personal Data of the Republic of Lithuania. For direct marketing purposes - only with the Buyer's consent.

2.7. The Buyer has the right to access their personal data, demand their correction or destruction.

2.8. The Seller undertakes to ensure the security of personal data.

2.9. Personal data is stored for 1 year or until the data subject requests to stop their processing.

3. Rights and Obligations of the Buyer

3.1. The Buyer has the right to purchase goods in the e-shop in accordance with these Terms.

3.2. The Buyer has the right to withdraw from the purchase-sale contract by notifying the Seller in writing no later than within 14 days from the date of delivery of the goods.

3.3. The Buyer can exercise this right only if the goods have not been damaged, their appearance has not changed, and they have not been used.

3.4. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.

3.5. In case of data changes, the Buyer must immediately inform the Seller.

3.6. The Buyer undertakes not to disclose their login data to third parties.

3.7. By using the LaBody e-shop, the Buyer agrees to these Terms and undertakes to comply with them.

4. Rights and Obligations of the Seller

4.1. The Seller undertakes to create all conditions for the Buyer to properly use the e-shop services.

4.2. If the Buyer attempts to harm the security of the e-shop, the Seller has the right to restrict or suspend the Buyer's ability to use the e-shop.

4.3. The Seller undertakes to respect the Buyer's right to privacy.

4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the specified address.

5. Order of Goods, Prices, Payment Procedure, Terms

5.1. In the e-shop, the Buyer can shop 24 hours a day, 7 days a week.

5.2. The contract becomes effective from the moment the Buyer clicks "Pay" and the Seller sends a confirmation email.

5.3. Prices of goods are indicated in euros, including VAT.

5.4. The Buyer pays in one of the following ways:

5.4.2. Payment by e-banking – the Buyer can pay using available banking offers.

5.4.3. Payment by bank transfer – advance payment by transferring money to the e-shop's bank account.

5.4.6. Payment by credit or debit card.

6. Delivery of Goods

6.1. The Buyer undertakes to specify the exact delivery location of the goods. The delivery fee is indicated on the e-shop page.

6.2. The Buyer undertakes to accept the goods themselves.

6.3. Goods are delivered by the Seller or an authorized representative (courier).

6.4. Delivery times are preliminary. In exceptional cases, delivery may be delayed due to unforeseen circumstances.

6.5. The Seller is released from liability for delay due to the Buyer's fault or circumstances beyond the Seller's control.

6.6. The Buyer must immediately inform the Seller about damaged packaging or an incorrect quantity of goods.

6.7. Packaging damage must be noted on the courier's delivery document in the presence of the courier.

7. Quality of Goods

7.1. The data for each product sold by LaBody is provided in the product description.

7.2. The Seller is not responsible if the color or shape of the product on the screen differs from the actual one due to the characteristics of the display.

7.3. Certain products have an expiration date indicated on the packaging.

7.4. The Seller undertakes to sell goods in such a way that the Buyer can use them until the end of their shelf life.

8. Return and Exchange of Goods

8.1. Returns of goods are carried out in accordance with the applicable legal acts of the Republic of Lithuania. Money is returned only to the payer's bank account.

8.2. A quality product can be returned within 14 days of delivery, by informing the Seller and indicating the product name, order number, and reasons for return.

8.3. When returning goods, it is necessary to have: original packaging; the product is undamaged; the product is unused and has not lost its commercial appearance; the same completeness; proof of purchase.

8.4. The Seller has the right not to accept goods if the return procedure is not followed.

8.5. If an unsuitable or low-quality product is returned, the Seller undertakes to replace it with a suitable one.

8.7. The Seller returns the money paid to the Buyer within 14 days of the notification of withdrawal.

8.8. When returning quality goods, delivery costs are not refunded.

8.9. The costs of returning goods are borne by the Buyer.

9. Liability of Buyer and Seller

9.1. The Buyer is fully responsible for the accuracy of the personal data provided.

9.2. The Buyer is responsible for actions performed using the LaBody e-shop.

9.3. The Buyer is responsible for disclosing login data to third parties.

9.4. The Seller is released from liability if losses arise due to the Buyer's failure to familiarize themselves with the Terms.

9.5. The Seller is not responsible for the content of other websites to which links redirect.

9.6. In case of damage, the culpable Party shall compensate the other Party for direct losses.

10. Marketing and Information

10.1. The Seller may initiate various promotions at its discretion.

10.2. The Seller has the right to unilaterally change the terms of promotions or cancel them.

10.3. The Seller sends notifications using the means specified in the Buyer's registration form.

10.4. The Buyer sends questions to the email addresses specified in the "Contacts" section.

10.5. The Seller is not responsible if the Buyer does not receive notifications due to communication disruptions.

11. Final Provisions

11.1. These Terms are drawn up in accordance with the laws and legal acts of the Republic of Lithuania.

11.2. All disputes shall be settled through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
